1 - PHYSICAL PREREQUISITES
An average physical conditioning but no previous mountaineering experience is required for day trips.
It is the responsibility of each participant to be aware of the fitness level for a particular trip. When in doubt, please call and discuss it with the hiking guide! You must inform the guide of any medical condition that requires attention or medication before the tour begins.

All bookings are made on the basis that you will strictly observe the safety instructions given by the hiking guide. The hiking guide reserves the right to exclude at any time participants from tours they are not fit enough for and where their involvement may jeopardise their own, other participants or the hiking guide safety. No refund will be made to participants excluded on these safety grounds.

The hiking guide is not responsible for non-performance and faulty performance of the contract in the following cases:
• Fault on your part before and during to the trip.
• For unforeseeable or unavoidable fault of a third party who is not involved in the performance of services as agreed upon in the contract.
• Act of a higher power or on an event which the hiking guide could not foresee or prevent in spite of all possible caution, in particular natural disasters and official government actions.
• Loss, theft or damage of personal effects, cash, objects of value, photo equipment during the duration of a tour.

The hiking guide reserves the right to change proposed venue, mountain objective, itinerary, activity booked should he believe that continuing with the proposed itinerary would place you, any group member and/or hiking guides at undue risk due to unfavorable weather conditions and/or participant ability.

2 - EQUIPMENT REQUIRED
Every participants are required to bring following equipment items for day and multi-days hikes: waterproof jacket with wood, windproof pant, hiking shoes covering the ankles, pullover, light gloves, sunglasses, min. 2 liters water, picnic lunch, personal medication.
The hiking guide will ensure that all participants have all the necessary equipment or clothing. The guide reserves the right to exclude participants who don't have the minimum equipment required.

3 - REGISTRATION & PAYMENT
Booking procedure
• Call or e-mail Trekking Austria to inquire about availability. An email with bank/Paypal details will be sent to you.
• Pay the deposit. Booking is not finalized until the deposit is paid! Once the payment is received and the cancellation policy is in effect. Upon signing it is implied and accepted that you have read and understood all the booking information and conditions and agree to abide by them.
• Remaining balance is due to the hiking guide directly on the day at the meeting location.

Minimum numbers apply: there is a possibility of cancellation after confirmation if there are not enough participants to meet requirements. In the event of this occurring, you will be offered an alternative or full refund of the deposit.

Trekking Austria is not responsible for any incidental expenses the customer may have incurred in reliance on the tour including, without limitation, expenses arising from the purchase of visas, vaccinations, non-refundable flights, or of any loss of enjoyment.

All prices quoted on the website are subject to change without notice.

4 - CANCELLATION
• BY THE HIKING GUIDE: the hiking guide reserves the right to cancel any trip because of causes that make it infeasible for the scheduling of the trip (conditions on the mountain, illness, injury or insufficient bookings). If this is the case, you will be informed within 24 hours prior to trip start date. In the event of this occurring, you will be offered an alternative or full refund of the deposit. The hiking guide and Trekking Austria are not responsible for additional expenses incurred by preparing for the trip.

• BY YOU: if you wish to cancel your trip, this must be done by email or sms. The following conditions will apply, according to when you inform the hiking guide:

DAY PUBLIC/SHARED HIKE:
- until 5 days prior to the tour: you receive a full refund of deposit
- within 5 days prior to the tour: loss of 100% of deposit

MULTIDAYS/PRIVATE HIKE:
- More than 30 days before trip start date: you receive a full refund of deposit
- 4 – 1 week before trip start date: loss of 50% of deposit
- Less than 8 days before trip start date: loss of 100% of deposit

• DURING A TOUR:
Once a tour begins, no refund will be given. If a tour has been started and cannot be completed (because of bad weather conditions, weak physical condition of the group by example), the hiking guide must be paid according to the duration of the tour. Payments are not refundable based on itinerary changes.


5 - TREKKING AUSTRIA AS INTERMEDIARY

In case I can't guide myself a hike, I can connect you with other hiking guides and enable you to request and conclude booking transactions with them.
My role is solely to facilitate the availability of hiking guides for customers and to provide certain services related thereto.

Hiking guides are independent contractors and are not employees, agents or representatives of Trekking Austria.
Trekking Austria does not control the timing and quality of the services actually delivered by the hiking guides, nor of the integrity, responsibility or any of the actions whatsoever of the hiking guides.
Trekking Austria is not responsible for any arrangements made between the client/participant and the hiking guide.
The legal contract for the supply of guiding activities and the corresponding booking transactions is between the hiking guide and you. The hiking guide and clients concerned are both solely responsible for their performance and Trekking Austria disclaims all liability arising from or in connection with such transactions.

There may be situations in which you are required to accept additional terms and conditions provided by the hiking guide. Any such terms will be in addition to the terms of Trekking Austria.

Trekking Austria reserves the right to change, modify or otherwise alter these terms at its sole discretion at any time. You must review these terms on a regular basis to keep yourself informed of any changes. The posting of new or revised terms on the site constitutes adequate notice to you of any and all revisions and changes.

BOOKING & PAYMENT:

• Call or e-mail Trekking Austria to inquire about availability. After you have submitted a booking request, Trekking Austria will then notify the concerned hiking guide by email and to accept or reject your request. Once the hiking guide has accepted your request for servic, you will be asked to pay a commission of approximately 30% of the total cost of the tour. An email with bank/Paypal details will be sent to you for this.
• Pay the deposit. Booking is not finalized until the deposit is paid! Once the payment is received and the cancellation policy is in effect. Upon signing it is implied and accepted that you have read and understood all the booking information and conditions and agree to abide by them.
• Remaining balance is due to the hiking guide directly on the day at the meeting location.

Once the hiking guide has accepted your request for service and your deposit payment has been processed to Trekking Austria, there is a binding contract between you and the hiking guide.

Additional costs for accommodation, food and transport can be in addition to the activity price. Trekking Austria is not responsible for administering any requests or claims related to or arising from any charges or payments between the guide and the customer and Trekking Austria disclaims any liability in this respect.

6 - YOUR RESPONSIBILITY & ACCEPTANCE
Mountain hiking and snowshoeing are activities with a danger of personal injury or death. You should be aware of and accept these risks and be responsible for their own actions and involvement.
Except in respect of death or personal injury caused by the negligence of the hiking guide, none of the hiking guides will be made liable for any illness, injury, death, loss or material damage that you may suffer in connection with this activity, nor for any failure by you to take out adequate insurance.

You are strongly encouraged to obtain suitable medical insurance prior to booking a tour.

7 - MOUNTAIN RESCUE INSURANCE
Insurance coverage is the responsibility of the participant. The settlement of a valid accident and health policy (with stipulations of mountain rescue coverage) covering any medical and/ or related costs (eg helicopter off the track, hospital care, etc.) is strongly recommended.
In Austria, you will always be asked to pay for mountain rescue and this could be several thousand euros, especially if helicopters are involved.
It is your responibility to verify that you are covered. Trekking Austria or the hiking guide accept no responsibility for costs incurred.

8 - RIGHT OF IMAGE
Trekking Austria may seek to use photos of participants for the website/publicity purposes without obtaining any further consent or payment in respect of such photographs and/or films. Please advise the hiking guide before the tour if you would prefer not to be involved in this.

9 - RELEASE & INDEMNITY
You agree that any legal action, remedy or liability that you seek to obtain for actions or omissions of the hiking guide will be limited to a claim against the hiking guide or other third parties who caused you harm at the exclusion of Trekking Austria to the fullest extent permitted by applicable law.

10 - COURT OF COMPETENCY AND RESPONSIBILITY
The exclusive place of juridiction is Vienna, Austria.
